Douglas M. Hall

Douglas M. Hall has two decades of experience handling all aspects of commercial and intellectual property litigation and transactional work. As part of his practice, he litigates all phases of intellectual property and commercial litigation, including pre-trial discovery, discovery, settlement and mediation, expert witness proceedings, Markman hearings, trials, and appeals to the Federal Circuit. In addition, Doug has significant experience in evaluating cases, freedom-to-operate opinions, drafting contracts, and negotiating intellectual property and technology licenses and settlements.

Doug spent the first eleven years of his career in Chicago, IL at one of the leading Plaintiff’s IP boutique law firms in the country – The Niro Firm. While there, he gained tremendous experience in formulating strategies for the enforcement, defense, monetization, and management of clients’ intellectual property portfolios covering a wide range of technologies and industries. His experience includes being lead counsel on cases involving patents, trademarks, copyrights, trade secrets, false advertising, e-commerce applications, domain name disputes, and breach of contract.

He was a key member of a team that successfully litigated and licensed a family of patents in video display and enhancement technology, achieving numerous multi-million-dollar settlements and licenses against leading silicon-valley and international technology companies. In addition, he was part of a four-person trial team that achieved $50 million+ willful patent infringement verdict in the Western District of Pennsylvania.

Doug has represented clients in a wide range of industries and technologies, including industrial equipment, video signal enhancement, cellular telephone, automotive, machine and consumer tools, nuclear reactors, construction equipment, e-commerce applications, computer implemented control systems, software systems, robotics, consumer healthcare systems, and medical devices.

A registered patent attorney, Doug graduated with a B.A. from Duke University in 1994, and from Duquesne University Law School in 1999, where he was a member of the Law Review. He is a member of the Pittsburgh Intellectual Property Law Association and a barrister in the Western District of Pennsylvania Intellectual Property Inn of Court.

  • Part of four-person trial team that achieved a multi-million-dollar willful patent infringement verdict involving Financial Industry Software in the Western District of Pennsylvania.
  • Part of trial team that successfully litigated and licensed a family of patents in video display enhancement technology. Filed lawsuits in Illinois, Pennsylvania, Texas, and California against numerous silicon-valley and Fortune 500 companies.
  • Lead counsel in successful trademark and trade dress litigation for leading Food Services company in the District of Massachusetts regarding the packaging and advertising of a candy product. Received a favorable monetary and injunction settlement after a lengthy mediation with the Court.
  • Lead counsel in successful false advertising claim for leading Medical Device company in the Western District of Pennsylvania. Received a favorable injunction settlement after a lengthy preliminary injunction hearing.
  • Lead counsel defending Heavy Machinery Manufacturer for various trademark violations and domain name theft under the Anti-cybersquatting Consumer Protection Act. Conducted fact discovery and depositions and reached a favorable settlement.
  • Lead counsel in successful trademark and e-commerce dispute for leading Industrial Equipment manufacturer in the Western District of Pennsylvania regarding unauthorized use of trademarks in Google ads and in the metadata on a competitor’s website.
  • Lead trial counsel in copyright infringement action involving the digital millennium copyright act and the only existing concurrent photograph from the 9/11 plane crash in Somerset, PA. Successfully defeated summary judgment motions after lengthy discovery process. Case successfully settled on the eve of trial.
  • Represented Biotech Company in enforcement and devising a strategy for naming and branding their resulting cellular products.
