Session Details

Title: “MCS-90 Endorsement: Purpose, Application, and Avoiding Strategic Missteps When Coverage Defenses Are Present”
Date: Tuesday, March 3, 2026 Time: 1:00 p.m. ET / 10:00 a.m. PT
Format: Live Webinar with Live Q&A

What You’ll Learn

Federal motor carriers are required to demonstrate financial responsibility for damage to the public, and the MCS-90 endorsement is one key mechanism for doing so. But this endorsement is far from straightforward, and the stakes for misunderstanding it are high. Frank’s session will provide practical guidance on the critical issues at play, including:

  • Understanding the purpose and scope of the MCS-90 – Learn how this federal endorsement differs from a standard insurance policy and why that distinction matters in coverage disputes
  • Navigating the four primary approaches to applicability – Courts across the country take varying approaches to determining when the MCS-90 endorsement is triggered; knowing the landscape is essential for effective representation
  • Avoiding strategic missteps – When coverage defenses are present, uninformed decisions can expose insurers to bad faith allegations and even punitive damages
  • Addressing subrogation considerations – Understand the reimbursement rights that come with MCS-90 payments and the practical limitations that often make subrogation more complicated than it appears
