FMCSA Electronic Logging Devices Required for Commercial Truck Drivers
Compliance Date is December 18, 2017
All motor carriers and drivers are required to comply with the installation of electronic logging devices (ELD) as required by the Federal Motor Carrier Safety Act. (See Electronic Code of Federal Regulations 49 CFR Part 395)
Phase 2: (Phase-In Compliance Phase)
December 18, 2017 to December 16, 2019
Motor Carriers and Drivers can use:
- AOBRDs that were installed prior to December 18, 2017
- Self-Certified and ELDs registered with FMCSA
Make certain that the specific ELD model you are considering is on FMCSA’s list of registered ELDs. Before choosing an ELD, request that the vendor verify that its device meets all ELD specifications.
Exceptions to the Phase 2 compliance include, but are not limited to:
- Short haul operators – (drivers who operate within a 100 air-mile radius of the normal work reporting location)
- Driver-salesperson
- Driver of ready-mixed concrete delivery vehicle (specific requirements)
- Retail store deliveries – (100 air-mile radius between December 10 and December 25)
- Agricultural operations – (any agricultural commodity, non-processed food, feed, fiber or livestock)
- Drivers of vehicles manufactured before model year 2000
Electronic logging device (ELD) means a device or technology that automatically records a driver’s driving time and facilitates the accurate recording of the driver’s hours of service, and that meets the requirements outlined under the regulations.
Drivers must understand and be able to use ELDs by the required deadline, including how to annotate and edit RODs, certify RODs and collect required supporting documents. Drivers and motor carriers need to know how to display and transfer data to safety officials when requested.
Although ELD Rules are meant to streamline record keeping, drivers and carriers are still required to retain supporting documents in paper or digital form to verify Hours of Service Compliance.
